VA Disability Attorneys for Iraq & Afghanistan Veterans with TDIU Claims
Total Disability Based on Individual Unemployability (TDIU) is a 100% disability rating for veterans whose service-connected disabilities prevent them from maintaining a job or career. This specific rating provides veterans with an alternative to a more traditional disability rating based on the severity of service-connected injuries, illnesses, and medical conditions — and TDIU impacts many veterans across multiple conflicts. More than 350,000 veterans currently receive TDIU compensation, and with more than 41% of Iraq and Afghanistan veterans receiving disability compensation, there are many who may be eligible for TDIU benefits.
VA Benefits Attorneys is a nationwide resource for veterans and we stand ready to serve as VA disability attorneys for Iraq and Afghanistan veterans with TDIU claims.

Are you a veteran? Do you have a service-connected injury, illness, or medical condition? Does your medical condition prevent you from a job or career that would be considered substantially gainful employment? You may be eligible for TDIU compensation from the U.S. Department of Veterans Affairs. Veterans who receive a TDIU designation will receive compensation and benefits based on a 100% disability rating — without having to change your disability rating. Veterans can qualify for TDIU compensation via two pathways — Scheduler and Extrascheduler — that are rated under 38 CFR § 4.16(a) and 38 CFR § 4.16(b).
How We Can Help
Legal Support and Services for Iraq and Afghanistan Veterans with TDIU Claims
Veterans of the conflicts in Iraq and Afghanistan have witnessed and experienced more than 20 years of war that have left many men and women with service-connected injuries, illnesses, and medical conditions that impact day-to-day life. These men and women possess the highest average number of service-connected disabilities of any era, and Post-9/11 veterans average 9.61 unique service-connected disabilities per person, and more than 50% have a disability rating of 70% or higher. Veterans with multiple disabilities that prevent them from working at a level that supports their families may be eligible for TDIU compensation — and VA Benefits Attorneys can help.
Establish Service Connection
To be eligible for TDIU compensation and benefits, veterans must be able to establish a clear service connection for their claim. Veterans must have a current medical diagnosis, documentation to illustrate the event that caused the disability, and a medical nexus from your medical provider. Establishing a service connection for a TDIU claim may be more complicated based on whether it is a scheduler claim that looks at combined disability ratings for one or more disabilities or an extrascheduler claim that examines unique medical conditions tied to a disability.
Collect Evidence and Documents
The evidence needed to file a successful disability claim is a bit different when you apply for TDIU benefits. Veterans will still need to be able to provide basic documentation that proves a medical diagnosis and shows functional limitations, and must provide a medical nexus in support of their claim. In addition to those core elements, veterans pursuing TDIU benefits and compensation may need to provide employment and earnings records that illustrate an inability to work substantially gainful employment with a service-connected disability, and must be able to provide lay statements that help show how a disability impacts your ability to work.
Appeal Denied Disability Claims
Many veterans who apply for VA disability benefits will experience the frustration of a denied claim — but that does not have to be the end of the road for your claim. An estimated 30% – 50% of initial disability claims are denied for many reasons that include a lack of documentation or evidence, a missing diagnosis, and much more. When veterans have their initial claim denied, they have three basic avenues of appeal to choose from — a higher-level review, a supplemental claim, or submitting an appeal to a veteran’s law judge. A qualified VA disability attorney — like VA Benefits Attorneys — can help you determine the right course of action.
Are You Eligible for a TDIU Disability Claim?
What Are TDIU Claims for Iraq and Afghanistan Veterans?
Many post-9/11 veterans who have returned home are plagued by multiple service-connected disability claims that can include mental health conditions like depression, physical injuries like chronic knee pain, or lung conditions caused by toxic exposure. These injuries, illnesses, and medical conditions take a toll and it adds up over time, preventing veterans from living a normal life, and even being able to work. When a veteran is unable to maintain substantially gainful employment due to service-connected disabilities and their symptoms, they may be eligible for TDIU compensation and benefits. Veterans with established disabilities can attain TDIU compensation benefits in one of two ways — scheduler or extrascheduler.
Veterans who file claims for TDIU benefits may qualify via the scheduler path (38 CFR 4.16A). To be eligible via this pathway, a veteran must have at least one service-connected disability with a 60% disability rating OR they must have a combined disability rating of 70% or higher with one medical condition rated at 40% or higher that have a negative impact on the veteran’s ability to work. The extrascheduler path (38 CFR 4.16B) applies to veterans who have service-connected disabilities that do not meet the minimum scheduler disability ratings — but the condition has created unique conditions and circumstances that prevent the veteran from working. Extrascheduler claims are evaluated with a more comprehensive examination of the disability and how it impacts day-to-day life.

It can be a real challenge for veterans to cut through the red tape to receive the disability compensation they have earned with years of service. FAQ’s
FAQs About TDIU Claims for Iraq and Afghanistan Veterans
TDIU is a disability claim that allows a veteran to receive 100% compensation — even if their total disability rating is less. This designation provides financial support for veterans whose service-connected disabilities make it impossible to maintain substantially gainful employment.
Veterans who hope to receive TDIU benefits and compensation must have a single service-connected disability rating of 60% or higher — or a combined disability rating of 70% or higher with a single disability rated at 40% or higher.
These veterans may still qualify for TDIU with an extrascheduler claim. VA Benefits Attorneys help you submit specialized medical and vocational evidence to the VA Director of Compensation Service to prove your unique disability picture prevents you from working.
Yes. Your earnings must remain below the federal poverty threshold — which is considered “marginal employment”. You can only exceed this income limit if you are employed in a “protected work environment” that provides specialized accommodations for your disabilities.
