Veteran Burn Pit Exposure Disability Attorneys

The dangers in a military operation extend beyond combat. Many veterans who served in Iraq, Afghanistan, the Middle East, and parts of Africa found themselves exposed to dangerous airborne chemicals from burn pits — and many of these airborne chemicals have contributed to dangerous health and medical conditions for our veterans that include cancer and respiratory illnesses. The passing of the PACT Act in 2022 has made many of the medical conditions related to burn pit exposure eligible for disability compensation via the U.S. Department of Veterans Affairs. Filing a disability claim for the presumptive conditions tied to burn pit exposure can prove to be a challenge, and the VA Benefits Attorneys legal team is here to serve as your veteran burn pit exposure disability attorney.

    How We Can Help

Legal Support and Services for Veteran Burn Pit Exposure Claims

Have you been diagnosed with cancer after serving overseas? Do you battle a
respiratory illness? If you have served at a time or place where burn pits were common,
you may be eligible for disability compensation and VA Benefits Attorneys will provide you
with the legal support and advice that you need to file a successful claim for burn pit
    exposure.

    Establish Service Connection

The most important piece of the puzzle in any disability claim is to establish a clear connection between the veteran’s military service and their medical condition. Many of the medical conditions tied to burn pit exposure and the PACT Act are considered presumptive conditions. A presumptive condition is a diagnosed medical condition or illness that is assumed to be connected to military service if the veteran served in a specific location within a specific timeframe. With the help of a veteran disability attorney, you can establish a nexus for your medical condition with the right documentation, and receive the benefits you have earned.

    Collect Evidence and Documents

When you submit your disability claim, the evidence and documents provided with your claim will set the foundation for your case — and this is where an attorney with experience in veteran disability claims can help. The VA Benefits Attorneys legal team will ensure that you have all of the documents needed to file a successful claim, including your DD-214, deployment orders, medical records, and more. In addition to legal help and support, an experienced attorney can connect veterans with medical professionals that can help provide additional medical documentation for a claim.

    Appeal Denied Disability Claims

Many veterans don’t know that an estimated 36% of initial VA disability claims are denied for a multitude of different reasons, including insufficient evidence or the lack of a clear service connection. When a disability claim is denied by the Department of Veterans Affairs, it does not mean that you have run out of options. A veteran disability attorney can help appeal the denied claim by filing a Notice of Disagreement, requesting a Higher-Level Review, filing a Supplemental Claim, or representing your claim at a Board of Appeals.

Are You Eligible for a Burn Pit Exposure Disability Claim?

What Is Veteran Burn Pit Exposure?

The illnesses, injuries, and medical conditions related to burn pit exposure are different from other veteran disability claims. Many burn pit exposure disability claims are reliant on presumptive conditions and may not need to be tied directly to a specific event — but many of these presumptive conditions can have a massive impact on veterans and their families. The airborne chemicals that result from burning trash, waste, and more have been proven to cause a broad range of cancers, respiratory illnesses, and medical conditions. Medical conditions related to burn pit exposure and protected by the PACT Act include brain cancer, Glioblastoma, head and neck cancers, Lymphoma, Melanoma, asthma, chronic Bronchitis, Emphysema, Pulmonary Fibrosis, and more.

Veterans who file a disability claim tied to burn pit exposure and are impacted by the related medical conditions must meet specific criteria and be able to provide evidence to support their claim. Burn pit exposure claims require the veteran to provide a formal medical diagnosis that can include presumptive conditions that do not need a nexus for a successful claim or non-presumptive conditions that will require a medical nexus letter. In addition to medical diagnosis, veterans filing a burn pit exposure claim must have served in a location where burn pits were common in a specific timeframe and must have a discharge rating other than dishonorable. Veterans who need help filing their claim can enlist the services of a veteran disability attorney — like VA Benefits Attorneys — with experience in burn pit exposure claims.

    FAQ’s

Frequently Asked Questions About Veteran Burn Pit Exposure Claims

Presumptive conditions are medical conditions that are assumed to be connected to military service when the veteran has a specific medical diagnosis and served in a specific location at a specific time when they may have been exposed to dangerous conditions.

A veteran’s disability rating for presumptive conditions related to burn pit exposure will vary based on the medical condition. Disability ratings for respiratory illnesses are based on Pulmonary Function Tests (PFTs) and can range from 0% to 100%. Veterans with a cancer diagnosis will receive a temporary 100% disability rating that is re-evaluated after treatment.

The presumptive list is a list of more than 20 cancers and respiratory illnesses that the Department of Veterans Affairs assumes are connected to burn pit exposure and are detailed in the PACT Act.

The Burn Pit Registry is a database that tracks more than 4.7 million veterans and is managed by the U.S. Department of Veterans Affairs to track the long-term effects of burn pit exposure. Filing paperwork for the Burn Pit Registry and being included in the database does not replace a valid disability claim.
